Talak

13 Feb 2023 Ref-No#: 4698

I intended to give my wife 1 divorce, for being disruptive. She didn’t know about the divorce, and then when I gave, she said not in front of my child. She then said give me two, in the confusion I gave 4, but only meant to give 1, and had written a letter confirming I’m giving her 1 divorce.
We then made rejoo, after seeking advice from a ex Pakistani Shari’a court judge, who said my wife does not need to do halala as I intended 1, and we can live together..my family and relatives are saying I’m committing zina.
Please advise.

Answer

Wa’alaykum as Salam wa raḥmatullāhi wa barakātuhu,

In Ṭalāq, an explicit statement takes preference over an intention. Hence, all three divorces are valid, and your marriage is broken. Living together would be tantamount to Zīnā.
