Nikkah validity

06 Jan 2022 Ref-No#: 892

Assalamu Alaykum, please tell me if a Nikkah is valid in the following case :

A boy’s name is changed from the name of his biological father who is Shia to the name of his step father who is Sunni.

The boy, his family, the step father, the to be bride and her family know that the boy’s name was changed after marraige of the mother to a Sunni man and the background of the boy.

The boy knows his father as well. But his father is a practicing Shia and the boy is a practicing Sunni.

At the time of performing Nikkah, the name of the biological father will be taken verbally .But whose name should be written down on marriage certificate ? and does the boy have to change his name in documents even though he is a practicing Sunni and not Shia ?
JazakAllah Al Khair

Answer

Wa ʿAlaykumus Salām Wa Raḥmatullāhi Wa Barakātuh

In principle, the name of a person holds no bearings on the validity or invalidity of a Nikāḥ.

He may choose whichever of the two names he wishes to include in the Nikāḥ certificate.

Also, there is no need to undergo any changes in respect to any documents which contain his name.
