Divorce

09 Nov 2023 Ref-No#: 5523

Me and my husband got into an argument. Me (wife) got extremely angry and said to my husband in anger im going to give you a divorce you and then i said “talaq talaq talaq”. I want to know are we divorced or not? I did not say i divorce myself, i just said the above. I feel really bad for saying all this to my husband and even asked for forgiveness from allah swt, as i said all that in anger and didnt mean it. I dont want to divorce my husband and want to stay with him forever in sha allah. Also what does it mean if the husband has delegated me to give divorce? Where can i find this if it was written? And if it was said verbally which i dont remember of. I think, once when we got into an argument, not now before a year ago, i said to him i am going to divorce you and he said “do want you want i dont care, its upto you, its your choice” and i just said “ye dont worry i will” is that delegating me to divorce him? Also i think he said that back then, i cannot fully remember if he did or not but im assuming he did. So is our divorce valid now or not? Jazak allah khair

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Respected sister,
No divorce has happened. Your nikah is intact.

Women being emotional, Allah alHakim has not given them the authority of issuing divorce.

A husband may effect divorce himself or commission another (his wife or third party) to do so.
The person commissioned may affect the divorce there and then in that session. Delaying this right, nullifies it. However if the husband delegated the right for a specific time or permanently then the person commissioned will have this right accordingly.

Respected sister life is no joke, neither a bed of roses.

Try managing your anger and decide important life matters cool headedly and after complete analysis of the situation.

May you have a peaceful marital life.

And Allah Ta’āla Knows Best
