Landlord and Tenant Dispute

09 Dec 2021 Ref-No#: 4156

A Muslim landlord gave his Muslim tenant 2 months to vacate the property. He didn’t and have flimsy excuses. 6 months have passed and the landlord is frustrated. The tenant is moving but keeps leaving his garbage and valuables in the garage. He moved 3 houses down and gives excuses of lack of space for his stuff at the new place which the landlord doesn’t believe. Can the landlord throw the tenants stuff at the tenants very doorstep and/or profit off of the valuables that remain the garage?

Answer

Assalāmuʿalaykum Wa Raḥmatullāhi Wa Barakātuh

The landlord may drop off the tenant’s belongings where he currently resides, but to ensure that he is present at such a time. It may not just be left there without him being present and aware of it.

Also, the landlord may not derive any benefit from the belongings of the tenant without his permission.
