Am I due a refund?

A moulana asked me to take a training course he was providing to make my job easier when he employs me. I paid and took the course. After employment, he supplied no resources for the post. He wouldn’t pay any salary and even I asked him for my pay, he terminated my contract. Am I due a refund for the money I paid for the course as it was taken solely for his employment and at his insistence?

Answer

AssalāmuʿAlaykum Wa Raḥmatullāhi Wa Barakātuh

There are three separate issues here:

  1. The training course
  2. The employment
  3. The contract
  1. In common practice, the actual payments are made to undergo training rather than being made to be employed.
  2. The aspect of employment, in this case, may constitute an intent or promise.

Therefore, there will be no refund due to the fact that you had benefitted from the training program, though he will be held accountable if he had acted contrary to his word or promise.

  1. Furthermore, if there was a contract or agreement in place regarding salary, then the terms and conditions of that would be binding provided that it was mutually agreed upon.

Lastly, it cannot be understood that the course was taken up under duress because he was insistent. This is because, despite him asking and insisting, you had chosen to undergo such training.
