Question
As salamualaykum va rahmatullahi va Barkatahu.
Me and my husband had a fight few days back . I came to my mother’ s house and asked one advocate to send my husband notice of what decision we can make and have a discussion over the dispute and figure out. without my awareness advocate misunderstood the entire matter and sent my husband divorce papers directly written in Gujarati language , I only understand English language, I cannot read Gujarati. On my request to advocate to provide me the notice in English , He refused and said this is the only court format. Whatever is written in the paper is out of my knowledge , I signed then my husband read the entire notice and he signed it with intension. Now the advocate himself from his end mentioned 3 talak back months dates written on the notice were 27 MARCH – during this we lived together like husband and wife in the same house. 27 April is the second date during this time also we lived together in the same house and last date written is 27 May where I was going through impurity of miscarriage. My husband didn’t utter any word like talak or divorce from his mouth , he just signed the paper on 30th May 2024. and the paper was torn immediately knowing this is something wrong happened what we didn’t wished to do.
My question is, is it talak ? if yes then how many talak it counts ..if any condition left for our rujoo and we can stay together ..Pls help and guide ASAP.
Jazakallahu khaiyr
Answer
In the Name of Allāh, the Most Gracious, the Most Merciful.
Wa ‘alaykum us-salāmu wa-rahmatullāhi wa-barakātuh.
Respected sister,
By signing the divorce papers, your husband has confirmed the issuance of the divorce(s). The number of divorces declared will depend on the specific wording in the document.
• If the document specifies one or two divorces, your husband retains the right to revoke the pronouncement(s) during the ‘Iddah period, which typically lasts for three menstrual cycles. This act of revoking the divorce is known as Rujū’.
• If the document explicitly mentions three divorces, the marriage is considered irrevocably dissolved upon the husband’s signature. Reconciliation in this scenario necessitates a process known as Ḥalālah. This involves the wife entering into a subsequent marriage, consummating it, and then experiencing a valid divorce or the husband’s death. Following the ‘Iddah period of the subsequent marriage, the original couple may then remarry.
May Allāh grant you ease and clarity during this challenging time.
And Allah subhanahu wa ta’ala knows best.
