Is my divorce valid?

Question

I was forced to divorce my wife, I had no intention of divorcing her. Her father and some of their family friends forced me to sign the paper on which it says that i want to divorce her because our mindsets do not match. I did not pronounce even a single talaq. I was forced from the bride’s side to divorce her. I want to know if the talaq is valid or not as it was not my niyyah and i was forced to sign. Is it possible for us to live together again?

Wa’alaykum as-Salām wa raḥmatullāhi wa barakātuhu,

  1. Force and Coercion in Divorce: A verbal pronouncement of divorce by the husband is considered valid and effective, even if made under coercion.
  2. No Pronouncement of Ṭalāq: Since you did not verbally pronounce ṭalāq and were merely coerced into signing a document, the Ṭalāq is invalid. Islamic law typically requires a verbal pronouncement to effectuate a divorce. While a written statement can sometimes suffice, if it is signed under duress and without genuine intent, it does not meet the conditions for a valid divorce.
  3. Living Together Again: Given that the Ṭalāq is not valid, you and your wife remain legally married according to Islamic law. There is no need for a new marriage contract or formal reconciliation process. You may continue living together as husband and wife.
