Divorce with a non muslim husband

18 Nov 2021 Ref-No#: 4031

Assalaamualaikum warahmatullaahi wabaarakatu,

I married a non muslim hushand 22 years ago. I have reverted to Islam for 11 years. My husband and I have been sleeping in separated rooms since I reverted. I wear my hijab at home when my husband is there. We keep our “husband and wife” relationship for the sake of our son. Now our son is 18 years old and we have compromised to divorce next month. The whole process of divorce will take 6-9 months. For my case, is it permissible for me to start looking for a muslim hushand now? Or I must wait until the completion of the divorce process to do so? Is it necessary for me to wait for 3 months after the completion of divorce process to remarry?

Jazakillahu khairan

Answer

Wa ʿAlaykumus Salām Wa Raḥmatullāhi Wa Barakātuh

In the enquired scenario, it is not necessary for you to observe the 3 months of Iddah (waiting period),

We further invoke Allāh that He keeps you steadfast on this beautiful Deen and guide your husband to the right path.
