Calculation of Zakat

As salaam alaykum

If Zaid borrows money to invest it with ameer as a mudarabah transaction, now the business never work out and Ameer has the stock and is now asking Zaid if he can pay him back slowly the amount he invested.

Will Zaid add this amount on his Zakat calculation as debt he owes since he borrowed it?

Answer

Wa’alaykum as Salam wa rahmatullahi wa barakatuhu,

Borrow and Mudharaba are opposites; since the former is a loan, whilst the latter is an investment.

The laws will differ on both. If it was a loan, then Zakah should be paid.

If it was an investment, no party has to pay the other. They both need to share the losses. They both should decide what they are going to do with this remaining stock, and the ruling will be based on that.
