assalam o aliakum
i want to ask i met my wife many time alone in office room and door was locked and we spent times for several hours before rukhsati and we do thing many times which occur between in husband and wife but we didnot do proper intercourse because she was not willing to do before rukhsati and after that we faught and i said word talaaq
once and after i became clam apologized to her and ask for forgiveness … i want to know is shee still in my nikkah ,khalwat e sahiha is occured or not and i have any rights on her ?

Wa ‘alaykum as-salām wa raḥmatullāhi wa barakātuhu,

Khalwah Ṣaḥīḥah (valid privacy) refers to being alone in a secluded place with the possibility of intimacy without any interruption or deterrents.

Interruptions refer to someone walking in or noticing what the spouses are doing. Deterrents include the following three conditions:

  • Either spouse is ill
  • Either spouse is fasting
  • The wife has menses

If none of these three obstacles are present and the husband and wife are in seclusion, the marriage will be regarded as consummated, and observing ‘Iddah will be compulsory.

Khalwah Ṣaḥīḥah does not affect the validity of the divorce but has implications for other rulings, such as whether ‘Iddah must be observed. Regardless, the divorce is valid whether Khalwah Ṣaḥīḥah occurred or not.

Since you only mentioned the word ‘Ṭalāq,’ the divorce was revocable. Within the ‘Iddah period, you could take her back as your wife without a new Nikāh. If the ‘Iddah has expired, you may perform Nikāh and get back together again.
